Divorce proceedings essentially determine how you and your spouse dissolve your marriage relationship.

This includes how you divide your patrimonial estate (money, assets, houses, vehicles, furniture etc), how you and your spouse interact with your children after the divorce (residency, custody, rights of contact), and what monetary responsibilities you have towards each other after the divorce, and towards your children (maintenance).

If you and your spouse cannot agree on all or any of the above matters, you approach court to decide on your behalf. This is termed a contested divorce. If you and your spouse have agreed on how to deal with all of the above matters, you still need an experienced attorney to formalise the agreement in a well-crafted settlement agreement and parenting plan. This is termed an uncontested divorce. You will also need an experienced attorney to take you through the court process and regulatory requirements and to draft proper court pleadings. Divorce proceedings are inherently expensive. We recognise that not all our clients are able to pay the fees associated with a divorce, or require a divorce attorney to run a divorce for them, from point a to z, since they have already agreed to all the terms with their spouse.

Divorce Mediation

You and your spouse have exhausted all attempts at saving your relationship and make the decision to get divorced.

This is an emotional time in your life and tempers often get out of hand.

Neither you nor your spouse can agree on certain sticking points in the impending divorce, be it contact with your children, maintenance, division of assets or even who gets to keep the family pets.

So you decide to go to court. Both of you must appoint an attorney to act for you and if at all possible, your relationship with your spouse becomes even more strained, leading to lengthy and expensive litigation.

Our courts have indicated that they would prefer that couples firstly attend mediation prior to becoming involved in acrimonious divorce litigation.

Why?

Legal fees arising from a contested divorce could end up costing the parties in the region of R400 000.00. A mediated settlement of a divorce will cost the parties much less, ranging from anything between R5000.00 to R20 000.00.

This means that you and your spouse maintain a civil attitude towards each other, and you have more money to allow both of you to commence your new life, more money to cater for your children’s’ needs and the process is much quicker – a few months as opposed to the estimated 2 – 3 year period to finalise a contested divorce.

Even if the mediation does not result in all of you and your spouse’s disputes being resolved, it will at the very least result in certain points of dispute being resolved prior to litigation resulting in a quicker and cheaper divorce process.

It is important to keep in mind for a mediation process that we act impartially, we do not offer legal advice to either spouse, but may refer you to appropriate law where necessary, and most importantly, we strive to have you and your spouse reach a mutually acceptable solution.
